Legal 500

We are recognized as a market leader for our Competition Law practice by publications such as Chambers, Global Competition Review, Latin Lawyer and The Legal 500.  We participate in some of the most complex mergers and investigations into unlawful conduct.  The impact and number of the issues we have handled have been a source of specialized expertise on a wide variety of commercial activities, adding significant value to our service.

Our Competition/Anti-trust law practice covers three main areas: investigations into anti-competitive/anti-trust behavior, merger control filings, and legal advice.

Anti-competitive practices

We are actively involved in a large number of investigations opened by the competition authorities including a wide range of practices, such as price fixing and discrimination, market and client sharing, resale price fixing (in which we were successful in having the country’s first penalty imposed for behavior of this type annulled) and “excessive” pricing, predatory pricing, margin squeeze and various concerted and exclusionary practices, and abuse of a dominant position generally.  Our handling of these matters extends to appearing before administrative bodies and the courts, the latter including extraordinary appeals to the Argentine Supreme Court.

Merger control

We have notified before the competition authorities many of the country’s and the world’s major economic concentrations with affects in Argentina, in sectors as diverse as the steel and aluminum industry, banking, the beverages sector, pulp and paper, construction, cosmetics, publishing, energy, gas oil and its derivatives, industrial gases, the dairy industry, the media, pharmaceuticals, hardware, temporary workers, chemicals, retail, engineering services, telecommunications and air transport, among many others.  Our advice includes drafting procurement contracts, competition impact assessments, all representation before the competition authorities, attending informative and evidentiary hearings, and where necessary, undertaking a defense or objection to proceedings before the courts.

Legal advice

An important part of our practice includes providing advice on the prevention of various types of behavior that might potentially be covered by competition laws, for example concluding collaboration agreements between competitors or an analysis of commercial strategies.  We also undertake statutory audits of varying scope and offer training courses.
